If you do not agree to these terms, you must immediately discontinue use of the Service.

Your continued use of Tokenlytics constitutes your acceptance of these terms and any future modifications. We reserve the right to update these Terms of Service at any time, and such changes will be effective immediately upon posting.

2. Service Description

Tokenlytics is a cryptocurrency market analytics and insights platform that provides:

• Real-Time Market Data: Live cryptocurrency prices, market capitalizations, trading volumes, and 24-hour price changes
• Technical Analysis Tools: Comprehensive technical indicator calculations including RSI, MACD, Bollinger Bands, Moving Averages, Stochastic Oscillators, and more
• Market Insights: AI-powered market analysis, trend identification, and pattern recognition
• Trading Signals: Educational signals based on technical indicator combinations and market conditions
• Portfolio Tracking: Tools to monitor and analyze cryptocurrency holdings (view-only)
• Historical Data & Charts: Interactive price charts and historical performance data

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL TRADING DECISIONS AND INVESTMENT ACTIONS YOU TAKE.

Your Responsibilities:

• Independent Decision-Making: You acknowledge that any trading signals, insights, or analysis provided by Tokenlytics are for informational and educational purposes only
• Due Diligence: You are responsible for conducting your own research and analysis before making any investment decisions
• Trade Execution: You manually execute all trades on your chosen cryptocurrency exchange. We have no involvement in your trading activities
• Risk Assessment: You are responsible for understanding and assessing the risks associated with each trade or investment
• Compliance: You are responsible for complying with all applicable laws, regulations, and tax obligations in your jurisdiction
• Account Security: You are responsible for maintaining the security of your exchange accounts, wallets, and private keys

What We Do NOT Do:

• We do NOT execute trades on your behalf
• We do NOT require or store your exchange API keys
• We do NOT have access to your funds or cryptocurrency assets
• We do NOT provide personalized investment advice
• We do NOT guarantee the accuracy or profitability of any signals or insights

5. Scope of Services

Technical Indicator Calculations

Tokenlytics provides comprehensive technical analysis based on:

• Momentum Indicators: RSI (Relative Strength Index), Stochastic Oscillator, Williams %R
• Trend Indicators: Moving Averages (SMA, EMA), MACD (Moving Average Convergence Divergence), ADX
• Volatility Indicators: Bollinger Bands, Average True Range (ATR), Standard Deviation
• Volume Indicators: Volume-weighted metrics, On-Balance Volume, Volume Rate of Change
• Support/Resistance: Price level analysis, pivot points, Fibonacci retracements

Data Sources

Our platform aggregates data from multiple sources including:

• Binance API for real-time price and volume data
• CoinGecko API for market capitalization and rankings
• Proprietary algorithms for technical indicator calculations
• AI-powered sentiment analysis from market data

6. Prohibited Uses

You agree NOT to use Tokenlytics for any of the following purposes:

• Illegal Activities: Any purpose that violates local, state, national, or international law
• Market Manipulation: Attempting to manipulate cryptocurrency prices or engage in wash trading, spoofing, or other manipulative practices
• Unauthorized Access: Attempting to gain unauthorized access to our systems, other users' accounts, or connected services
• Data Scraping: Using automated systems (bots, scrapers) to extract data from our platform without written permission
• Reverse Engineering: Decompiling, disassembling, or reverse-engineering our algorithms or software
• Resale of Services: Redistributing, reselling, or sublicensing our services or data without authorization
• Misleading Conduct: Providing false information during registration or impersonating another person or entity
• System Abuse: Transmitting viruses, malware, or engaging in activities that could damage or disrupt our infrastructure

Violation of these prohibitions may result in immediate account termination and potential legal action.

7. Intellectual Property Rights

Ownership

All content, features, functionality, design, and technology of Tokenlytics, including but not limited to:

• Proprietary algorithms and technical indicator calculations
• User interface design and visual elements
• Software code, databases, and system architecture
• Logos, trademarks, and branding materials
• Documentation, educational content, and written materials

are owned by Tokenlytics and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Tokenlytics for personal, non-commercial purposes in accordance with these Terms of Service.

Restrictions

You may NOT:

• Copy, modify, or create derivative works of our platform or content
• Sell, rent, lease, or sublicense access to Tokenlytics
• Remove or alter any copyright, trademark, or proprietary notices
• Use our intellectual property for commercial purposes without written consent

8. Limitation of Liability

Trading and Investment Losses

• Any trading losses, investment losses, or financial damages resulting from your use of our platform
• Losses resulting from following signals, insights, or analysis provided by Tokenlytics
• Missed trading opportunities or unfavorable trade execution
• Market volatility, price slippage, or adverse market movements

Technical and Service Issues

• Service interruptions, downtime, or unavailability of the platform
• Data inaccuracies, delays, or errors in technical indicator calculations
• Third-party service failures (exchange APIs, data providers, etc.)
• Technical glitches, bugs, or system malfunctions

Indirect and Consequential Damages

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Emotional distress or reputational harm

Liability Cap

In no event shall our total aggregate liability exceed the amount you paid to Tokenlytics (if any) in the twelve (12) months preceding the claim.

TOKENLYTICS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

No Warranties

We explicitly disclaim all warranties, express or implied, including but not limited to:

• Merchantability: No warranty that the service is suitable for trading or investment purposes
• Fitness for Purpose: No warranty that the service will meet your specific requirements or objectives
• Accuracy: No warranty regarding the accuracy, completeness, or reliability of data, signals, or analysis
• Profitability: No warranty or guarantee of trading profits or investment returns
• Uninterrupted Service: No warranty that the service will be available, error-free, or secure at all times
• Security: No warranty that the platform is free from viruses, malware, or security vulnerabilities

10. Service Availability & Modifications

Service Availability

While we strive for high uptime and reliability:

• We do NOT guarantee 100% service availability or uptime
• Scheduled maintenance may cause temporary service interruptions
• We may suspend service for security updates, bug fixes, or infrastructure improvements
• Third-party dependencies (APIs, hosting providers) may cause service disruptions

Right to Modify

We reserve the right to:

• Modify Features: Add, change, or remove features and functionality at any time
• Update Algorithms: Modify technical indicator calculations or analysis methodologies
• Change Pricing: Adjust subscription tiers, pricing, or payment terms with reasonable notice
• Discontinue Service: Discontinue Tokenlytics entirely with 30 days' notice to users

Beta Features

Some features may be designated as "beta" or "experimental." These features:

• Are provided for testing and feedback purposes
• May contain bugs, errors, or inaccuracies
• May be modified or removed without notice
• Should not be relied upon for critical trading decisions

11. Account Termination

Termination by User

You may terminate your account at any time by:

• Contacting our support team at support@tokenlytics.io
• Using the account deletion feature in your account settings (if available)

Upon termination, your access to premium features will cease immediately. No refunds will be provided for unused subscription periods unless required by law.

Termination by Tokenlytics

We reserve the right to suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms of Service
• You engage in prohibited uses or illegal activities
• You abuse our platform or attempt to compromise system security
• Payment for subscription services fails or is disputed
• We are required to do so by law or regulatory authority

Effect of Termination

Upon account termination:

• Your access to the platform will be revoked
• Saved preferences and watchlists may be deleted
• Personal data will be handled according to our Privacy Policy
• Provisions of these Terms that should survive (liability limitations, dispute resolution, etc.) will remain in effect

12. Data Privacy & Security

Privacy Policy

Your use of Tokenlytics is also governed by our Privacy Policy, which explains how we collect, use, protect, and share your personal information.

Data Security

We implement industry-standard security measures to protect your data, including:

• Encryption of data in transit (SSL/TLS)
• Secure database storage with access controls
• Regular security audits and vulnerability assessments
• Employee training on data protection best practices

No API Key Storage

Tokenlytics does NOT require, request, or store cryptocurrency exchange API keys. We do not have access to your exchange accounts or ability to execute trades on your behalf.

13. Governing Law & Dispute Resolution

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Dispute Resolution

Informal Resolution: Before initiating formal proceedings, you agree to contact us at legal@tokenlytics.io to attempt to resolve any disputes informally.

Arbitration Agreement

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA), rather than in court.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement or violations of confidentiality obligations.

Class Action Waiver

You agree to resolve disputes with Tokenlytics on an individual basis only, and waive the right to participate in class action lawsuits or class-wide arbitration.

Limitation Period

Any claim or dispute must be filed within one (1) year after the cause of action arises, or it will be permanently barred.
